FIRST CLAUSE: Object.

We act as intermediaries between hotels, car rental users and to provide our customers the ability to search and book hotel accommodation online. Our service is based on information provided by hotels. We do our best to ensure that the information provided by this site is accurate, but we can not guarantee that all is understandable and without error, or take responsibility for interruptions or information not provided.

1.2 The terms "we" and "Top Hotels World" refer to Top Hotels World and "You" refers to the customer who makes a reservation through us, directly by this site or indirectly by any of our subsidiaries through which we provide the service. All reservations made by you through us are subject to the following terms and conditions as they exist at the time the reservation is made. We reserve the right to change these terms and conditions and You agree to accept and be bound by the terms and conditions prevailing at the time that You make use of our site.

SECOND CLAUSE: Limitations on Site Usage.

As a condition for the use of this site, to make a reservation through us or use any information, data or images from the site, you warrant and declare that you will not use this site or its information, images or data for unlawful purposes or for purposes prohibited by these Terms and Conditions and You agree not to modify, copy, distribute, transmit, publish, display, granting licenses to use, create derivative works from this site or sell products, services, software or information obtained from this site.

THIRD CLAUSE: Access Conditions.

4.3 You agree that when making the reservation, a percentage of the amount involved will be charged to your credit card. This percentage is variable, dependent on the accommodation or service you decide to recruit and will be clearly informed when making the reservation.

4.4 Providing services requires the prior subscription or registration of users. The registration must be made at the moment of the corresponding reservation.

4.5 All information you provide through the services must be truthful. For this purpose you guarantee the authenticity of all the data you provide as a result of prior registration or subscription. In any case You are solely responsible for any false or inaccurate statements you make and the damage caused to Top Hotels World or a third party for the information they provide.

FIFTH CLAUSE: Service Cancellation.

If you want to cancel your reservation with Top Hotels World, you can do it by navigating "My booking" (Personal Reservations' Panel of each user) and entering the reference number of the reservation.
The chosen hotel will have its own cancellation policy, which will be illustrated in the detail page that appears before booking. The cancellations made within the time limit set by the hotel (in most cases is 48 hours prior to arrival) will be free of charge. Any cancellation received after the deadline, or if you don't arrive at the hotel, the Hotel has the right to charge a cost of cancellation to be determined by each hotel and will be reported at time of booking.

SIXTH CLAUSE: Responsibility exoneration.

6.1 Top Hotels World does not guarantee the availability and continuity of their website and services. Where it is reasonably possible, Top Hotels World will previously give notice of interruptions in the operation of the website and services. Top Hotels World does not warrant the usefulness of the website and services to carry out any activity in particular.

6.2 Top Hotels World excludes, with the full extent permitted by law, any liability for damages of any kind that may be due to lack of availability or continuity of the functioning of the portal and services, the fraud utility that users have been attributed to the portal and services, to the fallibility of the portal and services, in particular, though not exclusively, to failures in access to the various portal websites or those from which services are provided.

6.4 The inclusion or offering for sale of any products or services on this page does not constitute an endorsement or recommendation of such products or services by Top Hotels World or its subsidiaries.
Top Hotels World, its subsidiaries and / or their respective suppliers here are exempt from all warranties and conditions with regard to information, software, products and related services, including all implied warranties and conditions of merchantability, adaptability for a special purpose, ownership and not rape.

6.5 The carriers, hotels and other suppliers who provide travel services or other nature to Top Hotels World are independent contractors and not employees or agents of Top Hotels World and its subsidiaries. Relations between the hotel or the supplier and its employees are totally alien to Top World Hotels and entire responsibility of the hotel or the supplier.

6.6 Top Hotels World and its subsidiaries are not responsible for the acts, errors, omissions, statements, warranties, negligence or violations of these suppliers, or for personal injury, death, damage to property or other damages or expenses arising from these. Top Hotels World and its subsidiaries do not assume any responsibility and will not make any reimbursement in the event of delay, cancellation, over sale, strikes, force majeure or other causes beyond its direct control and not be liable for any cost overruns, omissions, delays, redesigning routes or acts of any government or authority. In the event of overbooking at the hotel, the hotel is liable to You, forced to find an alternative accommodation equal to or higher category and location, assuming the hotel costs for this alternative accommodation.

SEVENTH CLAUSE: Compensation.

You agree to indemnify Top Hotels World, its subsidiaries and / or their respective suppliers as well as any of its officers, directors, employees and agents in connection with any claims, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including, in enunciative and not limitative form, legal fees and caused by:

• You or on behalf of You on the liability described above, or
• by others as a result of:
• the violation by you of these Terms and Conditions or documents referred to;
• the violation by you of any right of any third party,
• use by you of this site.

EIGHTH CLAUSE: Automatic Arrear.

The parties will fall in arrears automatically without any judicial or extrajudicial interpellation by the passage of time or for the mere fact of doing or not doing something contrary to the stipulations.

NINETH CLAUSE: Independency of the parties.

The relationship established on the basis of these terms and conditions is a business relationship between unrelated parties, without there being any kind of labour subordination between the parties.

TENTH CLAUSE: Integrity.

These Terms and Conditions form the total understanding of the parties regarding their subject matter and prevail over any other previous understanding to it.

ELEVENTH CLAUSE: Intellectual Property.

The content of Top Hotels World's website is protected by copyright. You agree not to copy, distribute, transmit, display, reproduce, publish, license, transfer or sell any information, software, products or services obtained from this website.

TWELFTH CLAUSE: Links to third parties sites.

Our web site contains links to other sites operated by third parties, not by Top Hotels World. These links are provided to you as a reference and for your convenience only. We are not owners or control the content of these sites and we are not responsible for their content or your use of them. We do not endorse the content of any of these sites.

THIRTEENTH CLAUSE: Suspension of the service.

Top Hotels World may suspend or withdraw at any time and without notice the provision of services to users who violate the provisions of these Terms and Conditions.

FOURTEENTH CLAUSE: Notifications.

(b) Through pop envoys during the delivery of services by Top Hotels World to You;

(c) Shipment by mail to your address when it has been previously brought to the attention of Top Hotels World. In this sense, all Notifications made by the user will be considered valid if they were conducted using the data and through the media earlier reported. To this end, You said that all data provided by You are true and correct, and undertakes to notify Top Hotels World all changes in data reporting.

FIFTEENTH CLAUSE: Applicabble law and jurisdiction.

The Parties agree to refer the interpretation and enforcement of these Terms and Conditions to the Uruguayan laws and courts of the city of Montevideo, respectively.
